This privacy policy explains how New Marketing Vertical LLC, 30 N Gould St, Ste R, Sheridan, WY 82801, USA, doing business as Vyro Health ("Vyro Health", "we", "us"), collects, uses, shares and protects personal information when you visit this website or use our services. It also contains our consumer health data privacy notice and describes the choices you have.
Health information that you share with a clinician or pharmacy through the telehealth platform is protected health information under HIPAA and is described in the HIPAA notice of privacy practices. Where this policy and the HIPAA notice overlap, the HIPAA notice governs protected health information.
1. Information we collect
Information you give us
- Contact details: name, email address, phone number, shipping address, date of birth and state of residence.
- Intake information: answers to health questions, current medications, treatment history and identity documents required for a prescription. This is collected by the partner telehealth platform on behalf of the treating clinician.
- Payment information, which is collected and processed by the payment processor. We do not store full card numbers.
- Messages you send to the care team or to us.
Information collected automatically
- Device and usage data: IP address, browser type, pages viewed, referring page, approximate location derived from IP address, and the time of your visit.
- Cookies and similar technologies, described in section 6.
Consumer health data
Some of the information above is "consumer health data" under state laws such as the Washington My Health My Data Act, Nevada SB 370 and the Connecticut Data Privacy Act: information that identifies your past, present or future physical or mental health status, including the fact that you have sought treatment for erectile dysfunction. We collect it only to provide the services you request, to communicate with you about them, and, with your separate consent, for marketing.
2. How we use information
- To route you to the telehealth platform, deliver the services and support you.
- To process payments and ship orders, through the partner platform and pharmacy.
- To send service messages about your intake, prescription and order.
- To send marketing messages, only with your consent, which you can withdraw at any time.
- To measure and improve the website, prevent fraud and abuse, and comply with legal obligations.
We do not sell your personal information or consumer health data, and we do not share it for cross-context behavioural advertising without your consent.
3. How we share information
- Clinicians and pharmacies. Your intake and identity information are shared with the licensed clinician who reviews it and, if a prescription is issued, with the compounding pharmacy that dispenses it.
- Service providers. Companies that host the website, deliver email and text messages, process payments, ship orders and help us measure the website, under contracts that limit their use of your information to our instructions.
- Legal and safety. When required by law, subpoena or court order; to protect the rights, safety or property of you, us or others; or to report adverse events as required.
- Business transfers. If Vyro Health is involved in a merger, acquisition or sale of assets, your information may be transferred, subject to this policy.
We do not share consumer health data with advertising platforms for targeting, and we do not use geofencing around healthcare facilities.
4. Your choices and rights
Depending on where you live, you may have the right to know what personal information we hold about you, to access it, to correct it, to delete it, to withdraw consent, to opt out of the sale or sharing of personal information and of targeted advertising, and not to be discriminated against for exercising these rights. California residents have additional rights described in the CCPA notice. Residents of Washington, Nevada and Connecticut may exercise rights over consumer health data, including a list of third parties with whom it has been shared.
To exercise a right, contact us at support@vyrohealth.com. We will verify your identity before acting and respond within the time required by your state's law, normally 45 days. If we decline a request, you may appeal by replying to our response; we will explain the outcome and, where required, how to contact your state attorney general.
You may opt out of marketing email through the unsubscribe link in any message and of text messages by replying STOP. Service messages about an active intake or order continue until it is complete.
5. Retention
We keep personal information for as long as needed to provide the services, to comply with legal obligations (medical and pharmacy records are subject to state retention periods that are typically several years), to resolve disputes and to enforce our agreements. Website analytics data is kept in identifiable form for no longer than 26 months.
6. Cookies and tracking
The website currently uses only cookies and local storage that are strictly necessary for it to function. If we add analytics or advertising measurement in future, this section will be updated before it takes effect, you will be shown a choice where the law requires it, and we will honour browser Global Privacy Control signals as an opt-out of sale and sharing.
7. Security
We use administrative, technical and physical measures appropriate to the sensitivity of the information, including encryption in transit, access controls and contractual obligations on service providers. No method of transmission or storage is completely secure, and we cannot promise absolute security.
8. Children
The services are for adults aged 18 and over. We do not knowingly collect personal information from anyone under 18. If you believe a minor has provided information to us, contact us and we will delete it.
9. Do Not Track and Global Privacy Control
We treat a Global Privacy Control signal as a request to opt out of the sale or sharing of personal information for the browser that sends it. We do not currently respond to Do Not Track signals, for which no standard exists.
10. Changes
We may update this policy. The date at the top shows when it last changed. Material changes will be announced on the website or by email before they take effect.
